Terms of Service

1. Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you (the "Society" or "User") and societyTALK ("we", "us", or "our") governing your use of the societyTALK platform and related services. By registering an account or using any part of the service, you confirm that you have read, understood, and agree to these Terms.
2. Service Description
societyTALK is a cloud-based management platform designed for self-managed housing cooperative societies (CHS) registered under the Maharashtra Co-operative Societies Act. The platform provides:
- Financial management including billing, receipts, payments, and accounting.
- Member, flat, tenant, vendor, and staff management.
- Facility, visitor, and complaint tracking.
- Society communications and document management.
- Reports including receipts & payments, income & expense, and balance sheet.
- Administrative tools for year-end processing and access control.
Features may be added, modified, or discontinued at our discretion. We will provide reasonable advance notice for significant changes.
3. Account Registration & Responsibilities
To use societyTALK, you must register an account. You agree to:
- Provide accurate, current, and complete information during registration and keep it updated.
- Maintain the confidentiality of your login credentials and be responsible for all activity under your account.
- Notify us immediately at info@societytalk.in if you suspect unauthorised access to your account.
- Ensure that only authorised committee members and designated staff are granted access within the platform's access control module.
Each society may have one primary administrator account. Accounting firms may administer multiple societies under a single firm account.
4. Acceptable Use
You agree not to use societyTALK to:
- Upload or transmit false, fraudulent, or misleading financial information.
- Attempt to gain unauthorised access to another society's data or to the platform's infrastructure.
- Reverse-engineer, decompile, or attempt to extract the source code of the platform.
- Resell, sublicense, or commercially exploit the platform without our written consent.
- Use automated scripts or bots to access or scrape the platform.
- Violate any applicable Indian laws, including the IT Act 2000 and its amendments.
5. Subscription & Payment
Access to societyTALK requires an active subscription. Subscription terms:
- Plans are available on monthly or annual billing cycles. Pricing is displayed on our Pricing page.
- Subscriptions auto-renew unless cancelled before the renewal date.
- We reserve the right to modify pricing with 30 days' advance notice to the registered administrator.
- Failure to pay may result in suspension of access until payment is received.
- All prices are in Indian Rupees (INR) and inclusive of applicable taxes unless stated otherwise.
6. Data Ownership
Your society owns all data entered into societyTALK — including member records, financial transactions, and documents. We act solely as a data processor on your behalf. We do not claim any ownership or rights over your society's data.
You may export your data at any time during an active subscription. Upon termination, data is retained for 12 months and then permanently deleted. See our Privacy Policy for full retention details.
7. Intellectual Property
societyTALK and all its components — including but not limited to the software, UI design, brand, reports, and underlying algorithms — are the exclusive intellectual property of societyTALK. Nothing in these Terms grants you a licence to use our intellectual property beyond operating the platform for your society's internal purposes.
8. Disclaimers & Limitation of Liability
The platform is provided "as is" and "as available". We make no warranties, express or implied, regarding:
- Uninterrupted or error-free operation of the platform.
- The accuracy of any financial calculations or reports generated (these depend on the accuracy of data entered by users).
- Fitness for any particular purpose beyond general housing society management.
To the maximum extent permitted by law, our total liability to you for any claim arising from use of societyTALK shall not exceed the subscription fees paid by you in the three months immediately preceding the claim.
We are not liable for indirect, incidental, consequential, or punitive damages, including loss of data, revenue, or business opportunities.
9. Termination
Either party may terminate the subscription at any time. Upon termination:
- Your access to the platform will be suspended at the end of the current billing period.
- Your data will be retained for 12 months and then permanently deleted.
- We may terminate your account immediately if you breach these Terms or engage in fraudulent activity.
10. Governing Law & Jurisdiction
These Terms are governed by the laws of India. Any disputes arising out of or relating to these Terms or your use of societyTALK shall be subject to the exclusive jurisdiction of the courts in Pune, Maharashtra, India.
11. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date and, for material changes, notify registered administrators by email at least 14 days before the changes take effect. Continued use of the platform after that date constitutes acceptance of the updated Terms.
